I. Industrial Sources

The Salinity Standards state that "the objective for dis-
charges shall be a no-salt return policy whenever practi-
cable." This is the policy that shall be followed in is-
suing NPDES disch~rge permits for all new industrial sources,
and upon reissuance of permits for all existing industrial
sources, except as provided herein. The following addresses
those cases where no-discharg~ of salt may be deemed not to
be practicable.

A. New Construction.

1. New construction is defined as any facility from which
a discharge may occur, the construction of which is com-
menced after October 18, 1975. (Date of submittal of
water quality standards as required by 40 CFR 120,
December 11, 1974.) Appendix A provides guidance on
new construction determination.

a. The Department of Health may permit the dis-
charge of salt upon a satisfactory demonstration
by the permittee that it is not practicable to
prevent the dischar~e of all salt from proposed
new construction. '

b. The demonstration by the applicant must in-
clude information on the fOllowing factors re-
lating to the potential discharge:

(1) Description of the proposed new con-
struction.

(2) Description of the quantity and salini-
ty of the water supply.

(3) Description of water rights, including
diversion and consumptive use quantities.

(4) Alternative plans that could reduce or
eliminate salt discharge. Alternative plans
shall include:

(a) Description of alternative water
supplies, includjng provisions for
water reuse, if any.
