It has 6 major components: <br /> <br />(1) The tribes receive rights to. specified <br />amounts of water from the Animas-La Plata <br />and Dalores Projects and additional rights <br />to certain quantities of water fram various <br />rivers and streams which pass through their <br />reservations. The Final Settlement Agree- <br />ment quantified the priority, amount and <br />source of the reserved water right and <br />identified the place af use, type of use, <br />and diversion points for the water rights. <br /> <br />(2) The manner in which these water rights <br />will be used and administered was speci- <br />fied, including praceedings to be followed <br />for changes in type, place or time of use; <br />regulation of surface diversions; sharing <br />af stream flaw data; and beneficial use <br />limitations. <br /> <br />, , <br /> <br />(3) The tribes waived ancillary breach of <br />trust claims against the United States and <br />all other claims to water. <br /> <br />(4) A $60.5 million tribal development <br />fund was established to enable the tribes <br />to develop their water resources and to <br />otherwise make their reservations economi- <br />cally self-sufficient. <br /> <br />(5) A non-federal cost-share commitment <br />for the Animas-La Plata Project and the <br />tribal development funds was pravided. <br /> <br />" <br /> <br />'+, <br /> <br />~ <br /> <br />(6) Certain federal deferrals of recla- <br />mation project costs were agreed to. <br /> <br />In all, the Ute Mountain Ute Indian Tribe received the <br /> <br />right to beneficially use 25,100 acre-feet of water from the <br /> <br /> <br />Dolores Project, 33,000 acre-feet of water from ALP, and 27,400 <br /> <br />-9- <br />
