<br />02101 <br /> <br />MM4NE.R OF ""'-AK',NG THE STUDIES <br /> <br />23 <br /> <br />September 30th last past, the qllantities of water diverted by the <br />reporting city from the Colorado River System, and wl1ether and <br />to what extent such water was used directly or placed in storage. <br />After each city commences tlSe of Blue River water said report <br />shall also show by months for the same period the quantities of re- <br />turn flow from their municipalllSes of such Colorado River water <br />accruing to the South Platte River and to Fountain Cree~, re.lpec- <br />tively, as measltTed at the gauging stations provided for herein. <br />Each sllch report shall also show what steps, by legal action or <br />otherwise, the reporting city has tal,en during the period covered <br />by the report to utilize such retllm flow by exchange or other- <br />wise to the extent water of the Colorado River System is in- <br />cluded therein, so as to redlla or minimizc the demands of such <br />city upon Blue River water, The United States of America <br />reserves the right, at any time after usc of Bille River water com- <br />mences hereunder, to apply to this Court for injlll1ctive or other <br />remedial orders, sllspending or pro~)ortionately reducing diversions <br />or imposing conditions llpon the ta~ing of BIt,e River water by <br />the partiwlar city, if the United States sl1<l1l establish as a fact <br />that tile particlllar city has failed to exercise dlle diligence in ta~- <br />ing, with respect to retllrn flow of water of the Colorado River <br />System, all steps which in view of legal limitations and economic <br />feasibility, might reasonably be required of such city in establish- <br />ing, enforcing, lltilizing or operating, a plan designed to accom- <br />plish said reduction by such city of its Bille River water tlSe." <br /> <br />The amount of water equivalent to the part of the return <br />flow which would be developed by increased diversions by Denver <br />under its current construction program affected by the decree <br />that could be withheld by Denver or stored and later exchanged <br />was estimated. This study was directed to the economic and engi- <br />neering feasibility of such a procedure, The question of the legal <br />feasibility, referred to in the decree, is beyond the scope of this <br />report. <br /> <br />Methods of meeting the requirements of the decrees other <br />than the above are under consideration by the operating depart- <br />ment of the Board but have not advanced to the stage where <br />they can be reviewed here, <br />
