Clearly, however, actions inconsistent with continuing mining ~nd <br /> <br />mineral leasing are authorized by the act subject to the requirements of <br /> <br />S"ctions 2 and 4 to be discussed in a moment. <br /> <br />,lei ther can the law be construed to restrict the entry and settlement of <br /> <br />l~nd open to settlement under the public l(illd laws pending action inconsister.t <br /> <br />ther~.ith under this .'.ct, <br /> <br />Neither can the ~ct be construed as restricting the Secretary of the <br /> <br />Interior from disposing of lands under applicable statutes after the lund has <br /> <br />been classified in accordance with this act. <br /> <br />~hese constructions must be read together with :3ection 4, however, whi"," <br /> <br />proviaes that the publication of notice in the Federal Register by the ~;ecret".ry <br /> <br />of the Interior of a proposed classification shall have the effect of segregating <br /> <br />such land from settlement, location, sale, selection, entry, lease or other <br /> <br />formal disposal under the public land laws, including the mining and mineral <br /> <br />leasing act, except to the extent that the proposed classification would not <br /> <br />require such segregation or subsequent notification specifies that the lands <br /> <br />remain open for one or more such forms of disposal under the public land laws. <br /> <br />This is not substantially different from various procedures now in effect. <br /> <br />The ~ct provides, however, that the segregation shall not continue for <br /> <br />longer than two years unless the classification itself has been completed. <br /> <br />5 <br />
