Western and the Bureau of Reclamation shall continue to administer and manage <br />the generation. transmission and delivery of CRSP power as they have in the past. <br />provided that the annual costs to be charged to CRSP firm power purchasers shall <br />not exceed the sum of annual O.M&R of mills per kwhr (with annual <br />escalation?; how determine?). plus the mills per kwhr for repayment of <br />power investment with interest until repaid after application of other revenue <br />available for such'purpose. plus the amount per kwhr set forth in Section la. <br />above, plus the amount per kwhr required to repay debt service charges to the <br />entity financing the present value payment set forth in Section lb. above. <br /> <br />c. To assure Western's and the CRSP firm power purchasers' ability to perform <br />their obligations and commitments over a long term and under changing conditions, <br />Western is authorized to establish and use a fund for improving and making <br />additions to the CRSP transmission system without further approvals. CRSP power <br />revenues not required to be otherwise applied may be held, credited to the fund and <br />expended from the fund. CRSP firm power customers, alone or in combination. may <br />contribute to the fund for construction of transmission improvements and adaitions <br />and shall be entitled to the use of the improvements and additions on such terms <br />and conditions as agreed upon with Western. <br /> <br />. <br /> <br />3. <br /> <br />Effective Dates. <br /> <br />The dates for effectuating the concepts contained herein are subject to the <br />acquisition of all required approvals of every nature and the rendition of a final <br />jUdgement in any law suit Challenging the essence of any of the concepts. <br /> <br />4. Fish, Wildlife and Recreation Mitigation and Enhancement <br /> <br />A concept which calls for creation of a CRSP enhancement and mitigation fund <br />to which annual contributions from all interests would be required, to be <br />administered as they and representatives of the beneficial uses may agree, might be <br />something which CREDA and others could support. Annual contributions would be <br />fixed. and the contributions of each interest would be consideration for the <br />contribution of all other interests. For CRSP power facilities. the contribution <br />would be measured in terms of firm generation in accordance with contractual <br />obligations to deliver from amounts due to be paid. with payment to be made to the <br />Upper Basin States under Section la. above. Water users' contributions wi1~ be on <br />acre feet delivered; States' contributions on acre feet in storage; United States' <br />contribution on some formula related to GNP growth of Upper Basin States. or <br />something which reflects increases in Federal tax base which bears some <br />relationship to CRSP's existence and operations. <br /> <br />2 <br />
