<br />. <br /> <br />. <br /> <br />8/3/88 <br /> <br />CREDA CONCEPTS FOR AMENDING THE CRSP ACT* <br /> <br />1. Upper 8asin States Funding: <br /> <br />a. 8eginning in and subject to adjustment in , CRSP firm power <br />customers will provide annually for a term of years an amount determined by <br />multiplying the kwhrs of energy generated within the load patterning criteria of <br />the 1978 and post 1989 CRSP Criteria and from the CRSP hydro resources identified <br />in the post 1989 CRSP Marketing Criteria times mills per kwhr. <br /> <br />IThe present value ofl Funds so generated will be <br /> <br />(1) paid to the Upper Basin States provided an appropriate mechanism is <br />developed to insure that such funds will be applied by the Upper Basin <br />States for water related activities in the Colorado River Basin and for <br />fish, wildlife. recreation or environmental enhancement or mitigation <br />related to CRSP features or projects. or water activities of the states <br />partially funded with CRSP revenue; and <br /> <br />(2) expended on facilities supported by cost sharing arrangements consistent <br />with provisions of the Water Resources Development Act of 1986 (P.L. 99- <br />662). <br /> <br />b. On or before , CREDA <br />$ . which is the <br />CRSP firm power customers as of <br />drainage in excess of the irrigator's <br /> <br />or its designee(s) will pay <br />present value of the future <br />to repay the cost of <br />ability to repay. <br /> <br />the United <br />obligation <br />irrigation <br /> <br />States <br />of <br />and <br /> <br />c. The payments described in Section la. and lb. above shall constitute the <br />payment in full to be borne by CRSP power purchasers for all CRSP costs other than <br />(1) operation, maintenance and replacements (O,M&R) of CRSP generation and <br />transmission facilities~ (2) the repayment, with interest, of the original CRSP <br />investment costs allocated to power features and (3) the debt service associated <br />with the payment made under Section lb. <br /> <br />2. CRSP Firm Power Customers' assurances, limitations and certainties. <br /> <br />a. To assure CRSP firm power customers of their ability to perform the <br />obligations under Section 1. the United States will transfer and assign to CRSP <br />firm power purchasers a proportional interest in all CRSP hydroelectric power and <br />power privileges. <br /> <br />The interest transferred and assigned to each CRSP firm power customer shall <br />be ,in the ratio that customers' firm contract demand bears to the total of all firm <br />contract demands, shall be subject to further transfer and assignment only as <br />assurance to carry out the obligations of this Act and shall be subject to the <br />terms and conditions of the CRSP firm power customer contracts with Western. <br /> <br />* This material has been assembled by an informal working group of CREDA and has <br />not been presented to or approved by the CREDA Board of Directors. <br /> <br />1 <br />
