<br />00 <br />l~") <br />m <br /> <br />'-' <br /> <br />o <br />c:) <br /> <br />with the United States under the Salinity Control Act. <br /> <br />Furthermore, laterals and canals which are the subject of <br /> <br />salinity control measures should be excluded from the definition <br /> <br />of ditches or pipelines, the line of which must be described in <br /> <br />the articles of incorporation. We recommend the addition of the <br /> <br />following new paragraph to section 7-42-101, C.R.S.: <br /> <br />(3) A corporation organized or existing pursuant <br />to this article, including nonprofit corporations <br />electing to accept the provisions of the "Colorado <br />Non-Profi t Corporation Act," may state in the articles <br />of incorporation as a proper purpose entering into a <br />contract or contracts with the United States to <br />undertake and implement salinity control measures in <br />the Colorado River Basin pursuant to the Colorado River <br />Basin Salinity Control Act, 43 U.S.C. S 1571, et ~., <br />including the acquisition of the ownership of easements <br />or rights-of-way over lateral ditches and canals, <br />construction of salinity control improvements, and the <br />long-term operation and maintenance of .the improved <br />lateral ditches and canals. In the event a corporation <br />makes such statement in its articles of incorporation, <br />it shall not be required to describe in the articles of <br />incorporation the line of the lateral ditches and <br />canals which are the subject of salinity control <br />improvements. <br /> <br />Section 7-42-102, C.R.S., establishes timetables for the <br /> <br />construction of ditches and other improvements for which a ditch <br /> <br />or reservoir company is formed. <br /> <br />We recommend that section <br /> <br />7-42-102, C.R.S., be amended to contain a new paragraph (4), <br /> <br />making the construction timetables inapplicable to lateral <br /> <br />ditches which are to be the subject of salinity control measures: <br /> <br />(4) The provisions of this sectiorc shall not <br />apply to the acquisition or construction of salinity <br />control improvements with respect to ,the lateral <br />ditches and canals of any corporation organized or <br />existing pursuant to this article which includes in its <br />articles of incorporation the statements set forth in <br />section 7-42-101(3), C.R.S., and which enters into a <br /> <br />26 <br />
