Amendments to Statutory Authority. <br />1. Overall Approach. <br /> <br />In making our recommendations for amendments to statutory <br /> <br />authority, an attempt has been made to limit the effect of the <br /> <br />amendments to salinity control measures undertaken pursuant to <br /> <br />contracts with the Secretary of the Interior under the Salinity <br /> <br />Control Act. <br /> <br />It is hoped that by narrowly prescribing the <br /> <br />amendments, the amendments can be enacted without major objection <br /> <br />by other en ti tie s . <br /> <br />It can be envisioned, however, that other <br /> <br />ditch and reservoir companies organized under the Ditch and <br /> <br />Reservoir Companies Act may object to specific grants of power <br /> <br />for the purpose of implementing salinity control. <br /> <br />If that <br /> <br />occurs, the recommendations proposed herein can be enlarged to <br /> <br />encompass all ditch and reservoir companies. Obviously, it will <br /> <br />be the judgment of the Colorado Water Conservation Board as to <br /> <br />the best approach in obtaining the enactment of legislation as <br /> <br />recommended in this report. <br /> <br />2. Ditch and Reservoir Companies Act. <br /> <br />It is recommended that section 7-42-101, C.R.S., be amended <br /> <br />to allow for the inclusion in the articles of incorporation of a <br /> <br />corporation organized under the Ditch and Reservoir Companies Act <br /> <br />of a statement that its purpose may include undertaking and <br /> <br />implementing salinity control measures pursuant to a contract <br /> <br />25 <br />
