Typically, the easements or rights of way for the <br /> <br />laterals have not been obtained through written conveyance or <br /> <br />grant but rather through prescription or other non-record means. <br /> <br />IV. IMPROVEMENTS TO BE MADE TO LATERALS <br /> <br />From discussions with representatives of the Bureau we <br /> <br />understand that, under the Grand Valley unit project, the Laterals <br /> <br />will be enclosed in pipe buried at least three feet below ground <br /> <br />surface, that some of the pipes may be 3!z feet in diameter and <br /> <br />that a cushion of gravel is to be placed under the pipes. <br /> <br />Therefore, excavation of six feet or more will be required for <br /> <br />installation of most of the pipe lines. We also understand that <br /> <br />the Bureau contemplates that outlet valves and meters will be <br /> <br />installed at each point along the lateral pipelines where users' <br /> <br />private ditches depart to allow water to be turned into the <br /> <br />ditches and to measure this water. <br /> <br />2 A typical method of informal administration. consists of the <br />use of fixed or adjustable "division boxes" in the surface <br />laterals at the points where water is diverted to a user's <br />separate ditch. The division boxes are theoretically fixed or <br />adjusted so that a quantity of water equal to a particular user's <br />entitlement is diverted from the lateral while the remainder of <br />the water is by-passed down the lateral to supply the entitlement <br />of lower users. If rocks, dams or other obstruct.ions are placed <br />in the by-pass section of the division box, however, an inordinate <br />amount of water is diverted from the lateral to t.he detriment of <br />lower users. Such circumstances have proven to be a frequent and <br />recurring problem in the informal "administration" of water from <br />unincorporated laterals. Obtaining full cooperat.ion and <br />participation by the users in the cleaning and ma.intenance of the <br />laterals has also often proved to be a problem. Such problems <br />have been recognized by the State General Assembly and resulted in <br />laws aimed at facilitating the incorporation of lateral ditches. <br />Section 37-86-108, C.R.S. <br /> <br />-5- <br />
