<br />. <br /> <br />. <br /> <br />CJ <br />'::) <br />00 <br />,.:.:;; <br />o <br /> <br />will contract under the pertinent provisions of the <br /> <br />:":'1 <br /> <br />Salinity Control Act. <br /> <br />(2) Concurrently with (1) above, further investigation <br /> <br />be made of the desires of the present lateral water <br /> <br />users as to the size of Proposed Organizations to <br /> <br />be utilized. <br /> <br />(3) Each of the existing lateral ditch corporations be <br /> <br />reviewed to determine pertinent provisions in their <br /> <br />articles of incorporation and by-laws, ownership of <br /> <br />ditch rights and easements, and the present legal <br /> <br />status of such corporations. Also the possibility <br /> <br />of consolidation of lateral ditch corporations <br /> <br />should be investigated. <br /> <br />(4) Further, in-depth studies be made of the problems <br /> <br />of exercise of eminent domain in implementation of <br /> <br />the Grand Valley Unit. <br /> <br />(5) A study be made of the possibility of amending the <br /> <br />lateral ditch corporation law to ~llow its applica- <br /> <br />bility to more than one lateral and to obviate the <br /> <br />difficulty discussed in footnote 6, infra. <br /> <br />(6) A study be made of the means (inclusive of <br /> <br />statutory amendment) by which assurances could be <br /> <br />given that a Proposed Organization having the power <br /> <br />to tax would not exercise such power for purposes <br /> <br />of operation and maintenance of the Laterals unless <br /> <br />-40- <br />
