INTRODUCTION <br /> <br />By contract dated May 1, 1985, Dufford, WaldE~ck, Ruland & <br /> <br />Milburn, attorneys at law of Grand Junction, Colorado were engaged <br /> <br />by the State of Colorado acting through the Colorado Water <br /> <br />Conservation Board, to conduct legal research and supply a report <br /> <br />concerning formal organizations into which irrigation laterals in <br /> <br />the Grand Valley area could be organized. The fC.llowing <br /> <br />constitutes the report, comments and conclusions resulting from <br /> <br />such investigation. <br /> <br />II. SALINITY CONTROL ACT <br /> <br />In 1974 the United States Congress enacted the Colorado River <br /> <br />Basin Salinity Control Act (the "Salinity Control Act"), <br /> <br />subsequently amended to its present form in 1980. 43 U.S.C. 1571 <br /> <br />et seq. The Salinity Control Act authorized and directed the <br /> <br />Secretary of Interior (the "Secretary") to implement a program of <br /> <br />works for enhancement and protection of the quali,ty of Colorado <br /> <br />River water for use in the United States and Mexico and to enable <br /> <br />the United States to comply with its treaty obligations with <br /> <br />Mexico. <br /> <br />The "Grand Valley Unit," one of the works authorized under the <br /> <br />Salinity Control Act, was directed at reducing seepage from <br /> <br />irrigated lands in the Grand Valley into the Colorado River by <br />
