<br />co <br />(7) <br />t-- <br />'-.;) <br /><:J <br />~ <br /> <br />. <br /> <br />. <br /> <br />While the Water Conservancy District Act prcvides for <br /> <br />sub-districts, the board of directors of the district serves as <br /> <br />the board for the sub-district. <br /> <br />37-45-120, C.R.S. 1973. <br /> <br />Creation of an additional organization capable of levying <br /> <br />taxes in the economically depressed Grand Valley area could be an <br /> <br />impediment to organizing of the district(s). Alt.hough water <br /> <br />conservancy districts (as well as irrigation dist.ricts) have the <br /> <br />power to levy taxes and incur bonded indebtedness, such Districts <br /> <br />also have the power to charge tolls or fees for tche delivery of <br /> <br />water. Perhaps some type of assurance could be made to district <br /> <br />property owners, in the petition for formation or otherwise, that <br /> <br />the petitioners intend for all operation and maintenance costs of <br /> <br />the district to be defrayed from (1) reimbursements made by the <br /> <br />United States under the Salinity Control Act, and (2) toll charges <br /> <br />received from water users. See Section 37-45-121, C.R.S. The <br /> <br />extent to which such assurances could be made binding upon future <br /> <br />boards of directors of the district by amendment to the Water <br /> <br />Conservancy Act is outside the scope of our investigation, but is <br /> <br />deserving of further research and study. <br /> <br />Use of a water conservancy district, or several water <br /> <br />conservancy districts, as the Proposed Organization(s) has the <br /> <br />following advantages: <br /> <br />(1) A water conservancy district is a quasi-municipal <br /> <br />corporation designed for state purposes.
