Section <br /> <br />37-45-139, C.R.S. <br /> <br />The purposes of water conservancy districts as declared by the <br /> <br />General Assembly are quite broad and, in our opinion, legally <br /> <br />sufficient to qualify as an organization meeting the requirements <br /> <br />of the Salinity Control Act. One of the declared purposes of the <br /> <br />Act is to cooperate with the United States under the federal <br /> <br />reclamation laws and other agencies of the United States for the <br /> <br />construction and financing of works in the State of Colorado as <br /> <br />defined in the Act and for the operation and maintenance thereof. <br /> <br />37-45-102 (2) (c), C.R.S. <br /> <br />A water conservancy district is granted broad powers to <br /> <br />acquire, construct and operate works inclusive of pipelines, in <br /> <br />order to provide or deliver water for beneficial use and to fix <br /> <br />the terms and rates for water. Broad powers of eminent domain and <br /> <br />dominant eminent domain are delegated to a water conservancy <br /> <br />district to take property, "necessary to the powE,rs granted in <br /> <br />this article". Section 37-45-ll8(c), C.R.S. Moreover, the act <br /> <br />specifically contemplates that whenever the electcors of a water <br /> <br />conservancy district have authorized a contract ~lith United States <br /> <br />(in the manner specified in the Act) for construction and <br /> <br />acquisition of works, the district can obtain the necessary rights <br /> <br />of way needed to be conveyed to the United States. 37-45-119, <br /> <br />C.R.S. <br /> <br />-35- <br />
