Sections 37-46-110, 37-46-115, C.R.S. <br /> <br />In view of the evident desire of the Lateral owners to limit <br /> <br />the areal scope of any Lateral operating organizcltion so as to <br /> <br />achieve maximum local control, we do not believe a sub-district of <br /> <br />the River District would be the appropriate Proposed Organization. <br /> <br />The jurisdiction of the River District extends over some 14 <br /> <br />counties encompassing most of the Western Slope of Colorado and is <br /> <br />governed by a board of directors of which at least 13 out of 15 <br /> <br />are non-residents of Mesa County. <br /> <br />2. A Sub-district of the Ute Water Conservancy District. <br /> <br />The Ute Water Conservancy District (the "Ute District") was <br /> <br />organized pursuant to the Water Conservancy Act, principally for <br /> <br />the purpose of supplying domestic water to a larCje part of Mesa <br /> <br />County. Section 37-45-101, C.R.S. Its service area extends beyond <br /> <br />the geographical boundaries of the Grand Valley Unit. The primary <br /> <br />purpose and activity of the Ute District are the diversion, <br /> <br />storage, treatment and distribution of potable water for domestic <br /> <br />and municipal uses. <br /> <br />Because its jurisdictional area is larger than the Grand <br /> <br />Valley Unit, and because its principal purpose and activity is <br /> <br />different than the operation of irrigation laterals, we do not <br /> <br />believe that the inclusion of the Grand Valley Unit area as a <br /> <br />sub-district to be operated and maintained by th,~ Ute District <br /> <br />would accord with the desires of the Lateral users. <br /> <br />-18- <br />
