Commissioners Ela, Gearhart, Harrison, King, Laitos, <br />Pearson, and Sturges voted in favor of the motion. Commissioners McGrath <br />and Raitano voted against the motion. Additional oral comment on this <br />matter was heard. The written documents regarding this issue submitted by <br />several parties and non-parties in September were received into the <br />record. The Administrator was requested to provide notice to the parties <br />and other interested persons regarding the reopening of. the hearing. <br />Following a brief discussion regarding the relationship of this matter to <br />other scheduled hearings, the Commission agreed to proceed with triennial <br />review rulemaking hearings for other basins as currently scheduled. <br /> <br />BIOMONITORING ISSUES STATUS REPORT: <br /> <br />The Administrator briefed the Commission regarding the status of <br />discussions with EPA concerning outstanding issues relating to the <br />Commission's biomonitoring regulation and proposed draft 5 of potential <br />revisions to that regulation. Comments were also received from EPA and <br />the public. Following discussion, COmmissioner Laitos moved that the <br />Commission hold a rulemaking hearing to consider readoption of the <br />existing regulation. The motion died for lack of a second. Commissioner <br />McGrath moved that the Commission hold a rulemaking hearing in April, <br />1991, to consider readoption of the existing regulation, deletion of the <br />existing regulation and implementation of a biomonitoring program based on <br />policy documents, adoption of draft 5 of potential revisions to the <br />existing regulations, or adoption of any other alternatives that may be <br />proposed. Commissioner Harrison seconded the motion. The motion carried <br />on a vote of six to two. Commissioners Ela, Harrison, King, McGrath, <br />Raitano, and Sturges voted in favor of the motion. Commissioners Pearson <br />and Laitos voted against the motion. Commissioner Gearhart was not <br />present for this vote.
