~

Summary
October
Page 3

.
of Proceedings/Motions
1 & 2, 1990

.

.

CONTINUATION OF GUNNISON BASIN RULEMAKING DELIBERATIONS:

a vote of 7 to 2. Commissioners Ela, Gearhart, Harrison, King, Laitos,
Pearson, and Sturges voted in favor of the motion. Commissioners McGrath
and Raitano voted against the motion. Additional oral comment on this
matter was heard. The written documents regarding this issue submitted by
several parties and non-parties in September were received into the
record. The Administrator was requested to provide notice to the parties
and other interested persons regarding the reopening of. the hearing.
Following a brief discussion regarding the relationship of this matter to
other scheduled hearings, the Commission agreed to proceed with triennial
review rulemaking hearings for other basins as currently scheduled.

BIOMONITORING ISSUES STATUS REPORT:

The Administrator briefed the Commission regarding the status of
discussions with EPA concerning outstanding issues relating to the
Commission's biomonitoring regulation and proposed draft 5 of potential
revisions to that regulation. Comments were also received from EPA and
the public. Following discussion, COmmissioner Laitos moved that the
Commission hold a rulemaking hearing to consider readoption of the
existing regulation. The motion died for lack of a second. Commissioner
McGrath moved that the Commission hold a rulemaking hearing in April,
1991, to consider readoption of the existing regulation, deletion of the
existing regulation and implementation of a biomonitoring program based on
policy documents, adoption of draft 5 of potential revisions to the
existing regulations, or adoption of any other alternatives that may be
proposed. Commissioner Harrison seconded the motion. The motion carried
on a vote of six to two. Commissioners Ela, Harrison, King, McGrath,
Raitano, and Sturges voted in favor of the motion. Commissioners Pearson
and Laitos voted against the motion. Commissioner Gearhart was not
present for this vote. The Commission also requested that the
Administrator work with EPA toward the goal of having EPA provide input
into this rulemaking hearing within the same deadlines as parties.

PLEASE NOTE:

This is an abbreviated Summary of Proceedings and Motions; the full text
of these motions can be obtained in the Water Quality Control Commission
Office, 4210 East 11th Avenue, Room 319, Denver, CO B0202.

1598

OB62m/01BSm/dgg
