Submit revised drawings of changes in use of Government land made during <br />design and erection stages or after use of Government land is in operation. <br /> <br />1.03 PROJECT CONDITIONS <br /> <br />A. Reclamation has obtained a permanent easement for the construction and operation of the <br />Durango Pumping Plant from the Animas-La Plata Water Conservancy District. For <br />purposes of this specification land owner will be referenced as the Government. <br /> <br />B. <br /> <br />The permanent easement has several restrictions within it: (i) not to use the property for <br />any purpose other than public purposes as required by UMTRCA, 42 U.S.C. g 7901 et <br />sea., as amended; (ii) not to use ground water from the site for any purpose, and not to <br />construct wells or any means of exposing ground water to the surface unless prior written <br />approval is given by the Colorado Department of Public Health and Environment and the <br />U.S. Department of Energy; (iii) not to sell or transfer the land to anyone other than a <br />governmental entity within the state; (iv) not to perform construction of any kind on the <br />property unless prior written approval of construction plans, designs and specifications <br />is given by Grantor and the U.S. Department of Energy; (v) that any habitable structures <br />constructed on the property shall employ a radon ventilation system or other radon <br />mitigation measures; and (vi) that its use of the property shall not adversely impact <br />groundwater quality nor interfere with groundwater remediation under UMTRCA. <br />Reclamation is in the process of obtaining written approval of construction plans, designs, <br />and specifications from CDPHE and DOE to include the above concerns. <br /> <br />( <br /> <br />C. The proposed Durango Pumping Plant site is in an area where solid residual radioactive <br />materials have been removed by DOE and CDPHE under the UMTRA project. The <br />remediation was conducted in accordance with regulations promulgated by the United <br />States Environmental Protection Agency (EPA), in 40 CFR 192. After contaminated <br />soils were removed from the site, clean backfill was placed in sorne areas to restore the <br />topography. <br /> <br />D. During construction of the pumping plant, the Contractor may encounter anyone the <br />following soil/rock types: I) clean backfill; 2) clean bedrock or native materials; 3) <br />soils/rock with 6.6 pCi/g Radium or less; or 4) soils/rock exceeding 6.6 pCilg Radium <br />buried at depths greater than 6 inches. There is also the remote possibility of <br />encountering residual materials in excess of the standards. In addition, one area of the <br />site, known as grid H-38-20, was found to contain Thorium-230 in concentrations that <br />slightly exceed the cleanup standards. <br /> <br />Use of Site <br />01141 - 2 <br />
