PUBLIC UTILITY Dr::iTRICT, DEPARTMENT OF THE ARMY, AND <br />THE DEPARTMENT OF THE INTERIOR <br /> <br />The pa.rties !lamed in the title of t.his memorandum all being con....ersant. with <br />the terms and provisions of the attached bill for llIl act to authorize the Secretary <br />of the Navy to const.ruct), maintain, alld operate a dam Rnd reservoir on the Santa. <br />Margarita River in the .;tate of Qalifornia and for other purposes, have reached <br />the following: understanding relating to the operation of said proposed dam and <br />reservoir when authorized and construction thereof is completed: <br />1. As between the naval reservations and the Fallbrook public utility district, <br />division of the waters of the Santa Margarita River and of the DeLuz Reservoir <br />shall conform to the following: <br />(a) Until such time, immediately following construction of DeLuz Dam, alJ <br />the reservoir attains an active cont.ent of 63,000 acre-feet,' Naval Reservations <br />will satisfy their basic requirement.s but not exceed a draft upon the reservoir <br />of 8,000 acre-feet in any year except in the ca.se of a national emergency involving <br />mobilizat.ionj Fallbrook would satisfy its requirements to the extent possible <br />v.'ithout exceeding a draft upon the river or reservoir of 1,800 a.cre-feet. <br />(h) ACt.er the reservoir has attained an active content of 63,000 R.cre-fp-et, and <br />until an active content of 98,000 acre-feet has been attained, the Naval Reserva- <br />tions willsll.tisfy their basic requirements but not exceed a draft upon the reservoir <br />of 8,000 acre-feet in any yea.r except in case of a national emergency involving <br />mobilization; Fallbrook would divert from the river or reservoir the difference <br />between the firm yield indicated in the table above, and the Naval Reservations <br />8,000 acre-feet. <br />(e) When an active reservoir content of 98,000 acre-feet is reached, the 12,800 <br />acre-feet yield of the reservoir will have been divided, following the rule of (b), <br />8,000 acre-feet to the Naval Reservations except in case of a nationa.l emergency <br />invoking mobilization, 4,800 acre-feet to Fallbrook. These quantities represent <br />62.5 percent and 37.5 percent of the whole. Thereafter, and unt.il the reservoir <br />fills, the firm yield of the reservoir as indicated by the table above shall be divided <br />in that proportion. <br />(d) After the reservoir fills, and except in the case of National Emergency <br />involving mobilization, the 20,000 acre-feet firm yield would be dividedj 12,500 <br />acre-feet t;o the Na\"al Reservations, 7,500 acre-feet to Fallbrook. Water unsued <br />by either party after the reservoir fills initially would accrue to the credit of tha.t <br />party. Credit to the United States a.nd to FaJlbrook shaH not exceed 62.5 per- <br />cent and 37.5 percent respectively of that part of the conservation capacity that <br />would be unoccupied if no credits existed to either party.
