<br />Congress 01 Jauuary 6, 1951 (title 1212, Public La.w 910).
<br />(2) The subcommit,ee recommends to the Interior aud Insular
<br />Affairs Committee that legislation be approved which will make it
<br />unmIstakably clear that the control, jurisdiction, and distribution of
<br />water from the streams such as the Santa Margarita River are subject
<br />to State law and that the Federal Government has no control what-
<br />ever and no vestige 01 power or right over the waters of these non-
<br />navigable streams.
<br />The form of legislation necessary to accomplish these objectives
<br />can be developed in the meeting of the Committee on Interior and
<br />Insular Affairs. We are informed that Representative Clinton D.
<br />McKinnon, who represents the area covered by the Fallbrook public
<br />utility district, is drafting legislation in consultation with the local
<br />people which he believes will can'y out the recommendations of the
<br />subcommittee. We will bring a copy of this legislation to your at-
<br />tention as soon as it has been introduced.
<br />A copy of the memora.ndum of understanding between the Fall-
<br />brook utility district representatives and the local represent..tives of
<br />the Federal Government is attached, together with a letter of Decem-
<br />ber 22, 1949, from Capt. C. R. Johnson, United States Navy, to Mr.
<br />Franz R. Sachse, president of the Fallbrook public utility district.

<br />DEAR SIR: AB a result of conferences held at Camp Jogeph H. Pe.ndleton and
<br />the district public works office on December 12, 13, and 14, 1949, in connection
<br />with the proposed DeLuz Canyon Dam on the Santa Margarita River, the enclosed
<br />memorandum of understanding was approved by all interested parties. Ten
<br />copies of the memorandum are forwarded herewith.
<br />It is requested that the Fallbrook public utility district signify by resolution
<br />that the memorandum of understanding is satisfactory aud that five copies of the
<br />memorandum be executed and returned to this office, together with five certified
<br />copies of the resolution authorizing the approval. The approved copies of the
<br />memorandurp. will be forwarded to the Navy Department in Washington for
<br />signature of the Navy Department and the other interests that are a party thereto.
<br />A copy of the proposed bill authoriziug the construction of the dam is attached
<br />to the memoranduDl of understanding. It was suggested in the conferences that
<br />the portion of the bill providing th~t the Secretary of the Interior shall transfer
<br />to the Secretary of the Navy funds received by him Crom the operator be rewritten
<br />in order to assure that funds so transferred will not revert to the miscellaneous
<br />receipts oC the 'I't-easury, and will be available for expenses arising out of the
<br />operation of the reservoir.
<br />. A copy of the memorandum of understanding bas been delivered by hand to
<br />Mr. Phil D. Swing, attorney for the Fallbrook public utility district.
