<br /> <br />> <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />PART VII <br /> <br />MUTUAL AGREEMENTS OF ALL PARTIES <br /> <br />32. Each Party to this Agreement agrees not to <br />object to the Subdistrict obtaining any and all licenses, <br />permits, rights-of-way or other approvals required to permit <br />the immediate construction of the Windy Gap Project. All <br /> <br />such Parties agree to withdraw any former opposition to any <br /> <br /> <br />such licenses, permits, rights-of-way or other approvals and <br /> <br />further to not make any further objections or adverse comments <br /> <br />concerning the granting thereof. <br />33. Each Party to this Agreement will cooperate in <br /> <br />obtaining all licenses, permits, rights-of-way, or other <br /> <br /> <br />approvals necessary or required to permit the construction of <br /> <br /> <br />the Azure Reservoir and Power Project. If any person or <br /> <br /> <br />entity not a party to this Agreement should oppose the <br /> <br />construction of the Azure Reservoir and Power Project in such <br /> <br /> <br />a manner that said Project cannot be under construction <br /> <br />within 15 years, each Party, to the best of its ability, will <br />do everything possible to encourage the withdrawal of any <br /> <br />such objections ~o as to permit the construction of the Azure <br /> <br /> <br />Reservoir and Power Project as expeditiously as possible. <br /> <br />34. Each Party hereto will not oppose the granting <br />of Subdistrict's 1967 and 1978 appropriation dates for the <br />various features of the Windy Gap Project and for a new <br />appropriation of not to exceed 200 c.f.s. if such enlargement <br />is necessitated by reason of a need for a bypass imposed by <br />virtue of the provisions of paragraph 24 hereof. Subdistrict <br />may divert under its decrees an amount of water not in excess <br />of 90,000 acre feet in anyone year, and not to exceed an <br />average of 65,000 acre feet per year in any consecutive ten <br />year period. It is anticipated by the Parties that the long <br />term annual yield of water to the Subdistrict will be approxi- <br /> <br />mately 54,000 acre feet. <br /> <br />0928 <br /> <br />. <br />.' <br /> <br />-21- <br /> <br />
