River District and Middle Park agree to provide <br /> <br /> <br />for the purpose and subject to the limitation contained in <br /> <br /> <br />paragraph 9, subparagraph Second, 3,000 acre feet of capacity <br /> <br />in Azure Reservoir or substitute facility built pursuant to <br /> <br /> <br />this Agreement for the use and benefit of the Subdistrict, <br /> <br />thereby reducing the entitlement of Middle Park in Azure <br /> <br /> <br />Reservoir to 2000 acre feet. <br /> <br />30. River District will make satisfactory arrange- <br />ments to permit joint or other appropriate use by Subdistrict <br />of its pending Federal Energy Regulatory Commission (FERC) <br />application for a preliminary permit for the Azure Reservoir <br /> <br />power features or for such other appropriate arrangement as <br /> <br />may be agreed upon by River District and Subdistrict. <br /> <br /> <br />31.
