Any water so stored in <br />Granby Reservoir shall be the last of any Subdistrict water <br />to be spilled from Granby Reservoir, if such spill is required. <br />18. Subdistrict will not claim the use of Green <br />Mountain Reservoir for replacement purposes for the Windy Gap <br />Project operation. <br />19. Subdistrict will apply for an NPDES permit for <br />diversion and carriage of water to Granby Reservoir if the <br />same is required by law. <br />20. Subdistrict will pay its proportionate share <br />of any direct mitigation costs attributable to salinity on <br />the Colorado River which legally may be imposed at a future <br />date by any competent authority and which is proportionately <br />required of all users in Colorado of Colorado River water. <br />21. Subdistrict agrees to a water classification <br />for Granby Reservoir, Shadow Mountain Reservoir and Grand <br />Lake which will permit all present beneficial uses of these <br />reservoirs or lakes, but reserves its right to contest imposi- <br />tion of water quality regulations on its activities. <br />22. Subdistrict will not oppose the dredging of <br />Shadow Mountain Reservoir for water quality purposes, provided <br />that such work is scheduled in such a manner as to not inter- <br />fere with the essential operations of the Colorado-Big Thompson <br />Project and the Windy Gap Project. <br />23. Subdistrict shall withdraw its opposition to <br />any present River District Water Court proceedings in Water <br />Division 5 and 6. As long as Subdistrict is proceeding <br />diligently in the planning and construction of the Azure Reservoir <br />and Power Project, or its alternate, or the same is constructed, <br />River District agrees not to make a call on Subdistrict water <br />rights for the benefit of any of its present conditional <br />decrees with diversion points on the main stem of the Colorado <br />River above the confluence of the Colorado and Roaring Fork <br />Rivers, nor as to storage below such point on the Colorado <br /> <br />~ <br /> <br />0933 <br /> <br />-16- <br /> <br />
