<br /> <br />. <br /> <br />. <br /> <br />provided that no water may be diverted from the western slope <br /> <br />of Colorado (from streams west of the Continental Divide) <br /> <br />through said Windy Gap Project facilities prior to the initia- <br /> <br />tion of construction of such facilities contemplated in <br /> <br /> <br />paragraphs 6 and 12 hereof, or it is determined that such <br /> <br />facilities will not be constructed pursuant to the provisions <br /> <br />of paragraph 12: provided, however, that in the event of <br /> <br />actual requirements by any or all of the Windy Gap Project <br /> <br />participants for water for initial domestic, municipal or <br /> <br />power purposes within the boundaries of the Subdistrict, <br /> <br />directly or by exchange, diversions to the extent of such <br />requirements may pe made with th~ prior consent of River <br />District and such consent shall not be unreasonably withheld. <br /> <br />Subdistrict shall have the right to make the maximum <br /> <br />diversion necessary or possible, pursuant to paragraph 3(d) <br />of that Carriage Contract, Contract No. 14-06-700~7497, <br /> <br />between the Northern Colorado Conservancy District, United <br /> <br />States of America and Subdistrict, dated October 3, 1973, in <br /> <br />anyone year only and when the diversion will not interfere <br /> <br />with any beneficial consumptive use of water from the Colorado <br />River and its tributaries in western Colorado. <br /> <br />Diversions by the Windy Gap Project prior to com- <br /> <br />pletion of adequate facilities for diversion of water by <br /> <br />Ranchers shall not interfere with the delivery into Ranchers' <br /> <br /> <br />diversion facilities of their presently decreed prior rights <br /> <br />to water. <br /> <br />16. Subdistrict within one year after initiation of <br />the construction of the Windy Gap Project is under construction, <br />will advance a sum sufficient for the following purposes: <br />(1) payment of $25,000 to Grand County for salinity studies <br /> <br />of the Colorado River (the results thereof to be made available <br /> <br />without cost to all other parties hereto), (2) payment to <br />the Town of Hot Sulphur Springs of $150,000 for assistance <br />in improving its water treatment facility and $270,000 for <br /> <br />assistance in improving its waste water treatment facility, <br /> <br />~ <br /> <br />0936 <br /> <br />-13- <br /> <br />
