The amount of water herein allocated to <br /> <br />SulJdistrict may be reduced to 2000 acre feet depending <br /> <br />on the election of Middle Park as provided in Paragraph 17. <br /> <br />Third: The balance of the water yield of <br /> <br /> <br />Azure Reservalr shall be marketed by River District in <br /> <br /> <br />Colorado for the benefit of western Colorado on terms <br /> <br />and conditions to be determined by River District. All <br /> <br /> <br />revenues derived from the marketing of this water shall <br /> <br /> <br />be the property of River District. Provided, the alloca- <br /> <br /> <br />tions herein made shall be sulJject to the operational <br /> <br /> <br />priorities established in paragraph 10 hereof. Should a <br /> <br /> <br />dispute arise between the Parties hereto concerning any <br /> <br />conflict between the operating priorities described in <br /> <br /> <br />paragraph 10 and a specific contract for disposition of <br /> <br /> <br />Azure water, it shall be resolved by the Water Judge for <br /> <br /> <br />Water Division 5, sulJject to appeal as provided by law. <br /> <br />The Ranchers to the extent of their interest, if any, <br /> <br />shall be represented in any such proceeding by Middle <br /> <br />Park and River District pursuant to said District's <br /> <br /> <br />statutory obligations at no cost to the Ranchers. <br /> <br />10. Azure Reservoir and Power Project shall be <br /> <br />operated by an entity to be selected by mutual agreement <br /> <br /> <br />between SulJdistrict and River District. The reservoir shall <br /> <br />be op~rated by. the selected entity as nearly as practicable <br />according to the following priorities: <br />First: To comply with and satisfy the terms <br />and provisions of C.R.S. 1973, 37-45-118(1)(b)(IV). <br /> <br />Second: To satisfy future beneficial consump- <br />tive uses of water in Colorado for the benefit of western <br /> <br />Colorado and to replace out-of-priority Windy Gap project <br />diversions as set forth in paragraph 9, sulJparagraph <br />Second hereof. <br /> <br />-9- <br /> <br />,/ 0940 <br /> <br />
