<br />A water right has long been held by the Colorado Supreme <br />Court to be a property right. The actual effect of S.B. 453 is to <br />destroy property rights which are already vested in the people of this <br />state, by denying this board the opportunity to protect that right in <br />court. The denial of access to the courts would seem to violate <br />section 6 of article II of the Colorado Constitution, which provides <br />as follows: <br /> <br />"Courts of justice shall be open to every person, and a <br />speedy remedy offered for every injury to person, property or <br />character; and right and justice should be administered without <br />sale, denial or delay." <br /> <br />This board has prepared some amendments to S.B. 453 which <br />would make it acceptable and would solve some of the criticims now <br />being directed against the existing law.
