<br />. <br /> <br />. <br /> <br />,) <br /> <br />EBQI~'Il~f_If~~_!~2_~QUQlIlQ1~ <br /> <br />Certain terms and conditions must be placed on any pre- <br />1 iminary permit issued in this matter to prevent any unnec- <br />essary and avoidable adverse impacts on important wildl ife <br />species of the State of Colorado which could result from <br />the pre] iminary permit investigdtions proposed by the apol i- <br />cant. Tne terms and conditions requested herein were devel- <br />oped by the Colorado Jepartment of Natural Resources. Divi- <br />sion of Wildlife. The conditions proposed are the mlDl~um <br />.1umber necessary to protect impor"ant wildlife species in <br />the State of Colorado. If the appl icant's work plans are <br />amended then it would similarly be necessary to amend the <br />protective conditions to assure they will continue to serve <br />there intended purpose. <br /> <br />DJring the investigation to be carried out under the <br />proposed work plan there is great potential for adverse dis- <br />tJrDance to important wildlife species. In oarticular. <br />Nintering big game ana nesting pirds may be adversely im- <br />pacted by certain of the activities contemolated by appli- <br />c3nts. <br /> <br />f~~_!~Q_kffB_EBQlf~Il~f_'Q~QlIlQ~~ <br /> <br />Wintering elk and deer herds are always subject to <br />stress due to severe weather and other haoitat conditions. <br />An a~~ravation of the normal stress can result from the <br />activities of man in the Ninter season on the deer and elk <br />wintering groundS. SUCh an increase in stress can result <br />in a weakening of the animals and increase winter ~ill rates. <br /> <br />The data previously su~mitted by this intervenor shows <br />tnat the entire Oak Creek project area is within or adjacent <br />to tne Ninter ranye or critical winter range for elk ana/or <br />deer. In order to avoid harassment and stress to wintering <br />deer or elk nerds in the project area it is requested that <br />tne following conoition be imposed on any prel iminary permit <br />i ssueo to appl i cants. <br /> <br />~Qu~l~lQO_~Q~_l: No mechanized field work or ~lasting shall <br />ae aone witnin tne project area from ~ovember 15th of any <br />year until May 15th of the following year. <br /> <br />The imposition of tnis condition will work no substan- <br /> <br />-2- <br /> <br />0960 <br />
