<br />Lands which were owned by the state of Colorado or any <br />political subdivision thereof which were acquired by the United States <br />for any of the categories listed above cannot be counted in determining <br />payment eligibility. <br /> <br />"Local government" means a county or municipality. However, <br />little, if any, of the lands upon which payments are based are located <br />within the boundaries of municipalities in Colorado. For all practical <br />purposes therefore, the term local government means county government. <br />The payments to the respective counties during any fiscal year are <br />based upon one of two formulas, depending on which formula produces the <br />greatest revenue to the particular county. The two formulas are as <br />follows: <br /> <br />a. Seventy-five cents for each acre of entitlement land <br />located within the boundaries of the county, but not <br />to exceed a maximum figure computed on a population <br />basis. However, under this formula, the amount which <br />would otherwise be paid to the county will be reduced <br />by certain other payments made to such county from <br />federal funds as follows. <br /> <br />(1) The Act of May 23, 1908, relating to certain pay- <br />ments to be made by the Department of Agriculture. <br /> <br />(2) The Mineral Leasing Act of 1920. <br /> <br />(3) The Federal Power Act. <br /> <br />(4) Section 10 of the Taylor Grazing Act. <br /> <br />(5) Various other acts which do not appear to have any <br />great significance to Colorado. <br /> <br />The act requires that the governor of each state shall <br />certify annually to the Secretary of the Interior a <br />statement showing the amount of payments received from <br />the above sources which have been transferred to each <br />unit of local government within the state. <br /> <br />b. Ten cents for each acre of entitlement land located within <br />the boundaries of each county, but not to exceed a maximum <br />figure computed on a population basis. Under this formula, <br />there is no reduction for other federal payments, as is <br />the case under the first formula. <br /> <br />The amount of funds to be received by each county will there- <br />fore depend upon the number of acres of eligible federal land within <br />the boundaries of the county, and the amount of other federal funds <br />received from the specified sources. Regardless of other federal pay- <br />ments however, no county will receive less than ten cents for each acre <br />of entitlement lands. <br /> <br />Memorandum <br /> <br />-2- <br /> <br />January 24, 1977 <br /> <br />2463 <br />
