Sparks, Director <br /> <br />SUBJECT: Interrelationship of S.B. 35 (Distribution of Mineral Leasing <br />Funds) with P.L. 94-565 (Payment in Lieu of Taxes Act) <br /> <br />Pursuant to the direction of the Committee, the Board has made <br />an analysis of the potential relationship between the pending S.B. 35 <br />and the 1976 federal act providing for certain payments to county govern- <br />ments in lieu of taxes (P.L. 94-565, 90 Stat. 2662). A summary of the <br />federal act follows. <br /> <br />In 1976, the Congress enacted Public Law 94-565 (H.R. 9719) <br />which provided for certain payments to be made to local governments by <br />the Secretary of the Interior based upon the amount of specified public <br />lands within the boundaries of the various local governments. This act <br />is commonly referred to as the PILT Act (Payment in lieu of taxes). The <br />payments are to be made annually on a fiscal year basis, beginning with <br />the fiscal year starting October 1, 1976. However, no payments can be <br />made unless Congress specifically appropriates funds for such payments. <br />No such funds have been appropriated to date. <br /> <br />Payment entitlements to local governments are based upon <br />those federal lands within the boundaries of various local governments <br />which are dedicated to the following purposes: <br /> <br />1. The National park system. <br /> <br />2. The National Forest system. <br /> <br />3. Lands administered by the Bureau of Land Management. <br /> <br />4. Lands dedicated to the use of water resource development <br />projects of the United States. <br /> <br />2461: <br />
