<br />t....~,.. <br />I <br /> <br />proposed Changes to S. 1415 and H.R. 2642 <br />The Colorad~ Ute Indian Water Riqhts Settlement Act of 1987 <br /> <br />October 15, 1987 <br /> <br />The Departments of the Interior and of Justice, the State <br />of Colorado. the Ute Mountain Ute Tribe. and the Southern Ute <br />Tribe propose that the fOllowing changes be made to S. 1415 and <br />H.R. 2642. <br /> <br />1. Change section 4 of the bills to read as follows: <br /> <br />SEC. 4. TRIBAL RESERVED WATERS. <br /> <br />(a) WATER FROM ANIMAS-LA PhATA AND DOLORES <br />PROJECTS.--The Secretary is hereby authorized to use <br />the Animas-La Plata and Dolores Projects to supply <br />raGerved water to the Tribes in accordance with the <br />Agreement. <br /> <br />(b) APPLICATION OF FEDERAL RECr.AMATION <br />LAWS.--The reserved water supplied to the T=ibes or <br />their lessees from the Dolores nnd Animas-La Plata <br />Projects shall be treated in all respects in the same <br />manner, except as provided in the Agreement. as the <br />Tribes' other reserved waters. <br /> <br />2. Change subsection 5(a) of ~he bills to read as follows: <br /> <br />(a) GENERAL AUTHORITY.--Subject to the <br />approval of the Secretary and to the provisions of <br />its constitution, each Tribe is authorized. pursuant <br />to 25 USC 177. to enter into water use contracts to <br />sell. exchange, lease. or otherwise temporarily <br />dispose of water in accordance with ArtiCle V of the <br />Agreement, but the Tribes shall not permanently <br />alienate any water right. The m~ximum term of each <br />such water use contract. including all renewals. <br />shall not exceed 50 years in duration. The <br />authorization set forth in this subsection does not <br />address whether the sale, exchange. lease. or other <br />temporary disposition of water by the Tribes is <br />permitted or prohibited by--and therefore shall not <br />be interpreted to amend. construe. supercede or <br />preempt--any state law. Federal law, interstate <br />compact. or international treaty that pertains to the <br />Colorado River or its tributaries, including the <br />appropriation, use. development, storage, regulation. <br />allocation, conservation. exportation. or quality ~f <br />those waters. <br /> <br />50611:: <br />
