<br />4.~ ~ ~ <br /> <br />million payable in three annual installments to the two funds. <br />Subsection (b) provides for the additional payment of interest if <br />the three annual installments authorized by subsection (a) are not <br />made as called for by that subsection. <br /> <br />Subsection (c) sets forth how monies in the two funds shall be <br />invested by the Secretary and the process by which each Tribe may <br />submit its own tribal investment plan. Further provision is made <br />for the submittal by the Tribes to the Secretary of economic <br />development plans for the expenditure of the monies in a fund. <br /> <br />Subsection (d) provides that no part of the principal of the <br />tribal development funds. or of the income accruing from such <br />funds, shall be distributed to a member of either tribe on a per <br />capita basis. <br /> <br />SECTION 8. WAIVER OF CLAIMS <br /> <br />This section authorizes the Tribes to waive and release claims <br />concerning or related to the water rights described in the <br />Agreement and conditions the performance of the Secretary's <br />Obligations under the act upon the Tribes' execution of such <br />waivers and releases. <br /> <br />SECTION 9. ADMINISTRATION <br /> <br />This section authorizes the Secretary to comply with the <br />administrative procedures set forth in Article IV of the Agreement <br />when exercising his authority to administer water rights on the <br />Tribes' reservations. <br /> <br />SECTION 10. INDIAN SELF-DETERMINATION ACT <br /> <br />This section provides that design and construction of the <br />Animas-La Plata and Dolores Projects by the Bureau of Reclamation <br />shall be subject to the provisions of the Indian Self-Determination <br />and Education Assistance Act. Any preference provided the Tribes <br />by virtue of this section shall not detrimentally affect the <br />construction schedules of the projects. <br /> <br />SECTION 11. RULES OF CONSTRUCTION <br /> <br />This section provides how the act shall be construed. <br /> <br />SECTION 12. EFFECTIVE DATE <br /> <br />This section provides that sections 4(b), 5, and 6 shall take <br />effect on the date on which the final consent decree is entered by <br />the Colorado District Court. This section further prescribes how <br />monies appropriated to the tribal developmental funds shall be <br />handled pending the entry of the final consent decree or in the <br />event the decree is not entered by December 31, 1991. <br /> <br />/bj <br /> <br />9/8/87 <br /> <br />-3- <br />
