<br />002095 <br /> <br />F. Responsibilities of Reclamation. Reclamation will have the following responsibilities: <br /> <br />1. In accordance with the Tribal Resolutions for the division ofthe work, Reclamation <br />has the lead responsibility for designing this project. <br /> <br />2. To the extent the construction project is subject to NEP A or other environmental laws, <br />Reclamation shall make the [mal detenuination under such laws. <br /> <br />3. Reclamation may rely on the Contractor's cost estimate or Reclamation may obtain an <br />independent government cost estimate that is derived from the final project plans and <br />specifications. Reclamation shall obtain the cost estimate, if any, within 90 days or less after <br />preparing the final plans and specifications and shall provide all supporting docwnentation ofthe <br />independent cost estimate to the Contractor within the 90 day time limit. <br /> <br />4. Reclamation shall approve changes that require an increase in the negotiated contract <br />fixed-price or an increase in the negotiated perfonnance period or are a significant departure <br />from the scope or objective of the project. <br /> <br />5. Reclamation shall review and comment on specific shop drawings, as negotiated and <br />specified in the specifications for each Construction Contract for the individual project features. <br /> <br />( <br />, <br /> <br />6. Reclamation shall conduct appropriate inspection, testing, monitoring, and quality <br />assurance reviews throughout the duration of each Construction Contract for the individual <br />project features, as follows: <br /> <br />(a) Definition. "Work" includes, but is not limited to, materials, workmanship, <br />and manufacture and fabrication of components. <br /> <br />(b) All work perfonned under each Construction Contract shall be subject to <br />Reclamation inspection and testing at all places and at all reasonable times before <br />acceptance to ensure strict compliance with the tenus of the contract. Reclamation <br />inspections and tests will not: <br /> <br />(1) Relieve the Contractor of responsibility for providing adequate quality <br />control measures; <br /> <br />(2) Relieve the Contractor of responsibility for damage to or loss of the <br />material before acceptance; <br /> <br />(3) Constitute or imply acceptance; or <br /> <br />(4) Affect the continuing rights of Reclamation after acceptance of the <br />completed work under paragraph (g) of this section. <br /> <br />II <br />
