<br />002J33 <br /> <br />E. Responsibilities of the Contractor. By signing this Contract the Tribe agrees that <br />ultimate responsibility and accountability of the contracted projects resides with the Contractor. <br />The Contractor certifies that its purchasing, financial and property systems and staffing <br />(including management and architecturaVengineering resources) are adequate to satisfactorily <br />perform the work required under this construction project. The Contractor shall have the <br />following responsibilities: <br /> <br />1. Except for work performed by the Contractor's employees, the Contractor will <br />comply, as applicable, with the provisions of the Davis-Bacon Act, for Federally assisted <br />construction subagreements. <br /> <br />2. The Contractor shall subcontract with or provide the services of licensed and qualified <br />architects and other consultants needed to accomplish the work identified in the Construction <br />Contracts for the individual project features. <br /> <br />3. The Contractor shall administer and disburse funds provided through each <br />Construction Contract in accordance with subpart F, Sec. 900.42 through Sec. 900.45 and <br />implement a property management system in accordance with subpart F, Sec. 900.51 through <br />Sec. 900.60. <br /> <br />( <br /> <br />4. The Contractor shall direct the activities of project architects, engineers, and other <br />project consultants, facilitate the flow of information between the Contractor and its <br />subcontractors, resolve disputes between the Contractor and its subcontractors or between its <br />subcontractors, and monitor the work produced by its subcontractors to ensure compliance with <br />the specifications and drawings for each Construction Contract. <br /> <br />5. The Contractor shall direct the work of its subcontractors so that work produced is <br />provided in accordance with the budget and performance period as negotiated between and <br />agreed to by the parties for each Construction Contract. <br /> <br />6. The Contractor shall retain project records for a minimum of 3 years following <br />completion of each Construction Contract. <br /> <br />7. The Contractor shall subcontract with or provide the services of construction <br />contractors or provide its own forces to conduct construction activities in accordance with the <br />project construction documents for the individual project features or as otherwise negotiated <br />between and agreed to by the parties. <br /> <br />8. The Contractor shall manage or provide for the management of day-to-day activities of <br />each Construction Contract, including the issuance of construction change orders to <br />subcontractors except that, unless Reclamation agrees: <br /> <br />(a) The Contractor may not issue a change order to a construction subcontractor <br /> <br />9 <br />
