<br />002031 <br /> <br />PART III - PUBLIC LAW 93-638 PROVISIONS <br /> <br />SECTION 1 - TERMS, PROVISIONS AND CONDITIONS <br /> <br />A. Term. The term of this Contract shall be equal to the time required to complete the <br />facilities referred to in Part II. The completion date for the construction of all facilities is <br />estimated to be November 9, 2008. Specific performance periods for the individual features will <br />be included in the Construction Contract. <br /> <br />B. Effective Date. This Contract shall become effective on the date of execution by the <br />Contractor and Reclamation. <br /> <br />C. Program Standards and Guidelines. The Contractor agrees: <br /> <br />1. To conduct the activities listed in Part I, Subsection B of this Contract. <br /> <br />2. To utilize equipment, material, and articles, required to be incorporated into the work <br />covered by the individual Construction Contracts, that are new and ofthe most suitable grade for <br />the purpose intended; <br /> <br />3. To perform work defined under the individual Construction Contracts in a manner to <br />ensure the structural integrity of the project; and <br /> <br />4. To construct this project in accordance with the construction documents included in <br />each Construction Contract for the individual project features. <br /> <br />5. To adhere to the specified versions of all applicable health and safety standards and <br />all applicable Federal, state, local, tribal or other engineering and construction standards and <br />codes, and to applicable Federal guidelines and manuals identified in each Construction Contract <br />for the individual project features. <br /> <br />(a) Reclamation will accept tribally proposed construction procedures, standards <br />and methods which are consistent with or exceed Federal standards applicable to the <br />contracted construction functions or activities. <br /> <br />(b) Reclamation and the Contractor will both make a good faith effort to identifY <br />any other standards and codes applicable to this Contract, share them with the other party, <br />and refer to them by written modification to this Contract. <br /> <br />6. To follow the more stringent requirement in the case of conflicts between <br />Reclamation Safety and Health Standards and OSHA requirements. <br /> <br />7 <br />
