<br />OD2047 <br /> <br />WHEREAS, if Sky Ute Sand and Gravel and Weeminuche ConstmctionAuthority have a <br />dispute regarding performance, they will work together to resolve the issue, and if resolution <br />cannot be reached, they may request that the Contracting Officer help to resolve the issue; and <br /> <br />WHEREAS, if damages to the Weeminuche Construction Authority or Sky Ute result from the <br />Contracting Officer's decision, then the provisions of the Changes Clause shall apply; <br /> <br />NOW, TIIEREFORE BE IT RESOLVED that the Tribal Council hereby approves having Sky <br />Ute Sand and Gravel provide batched products as set forth in this Resolution; and <br /> <br />. <br />BE IT FINALLY RESOLVED that the Vice Chairman of the Ute Mountain Ute' Tn'be is <br />authorized to sign this Resolution and to take such further action as may be necessary to cmy <br />out the intent of this Resolution.
