<br />002046 <br /> <br />DATE: September 30, 2002 <br /> <br />RESOLUTION NO. 2002 - 163 <br /> <br />RESOLUTION <br />UTE MOUNTAIN TRIBAL COUNCIL <br />REFERENCE: APPROVAL TO HAVE SKY UTE SAND AND GRAVEL <br />PROVIDE BATCHED PRODUCTS FOR CONSTRUCTION OF <br />THE ANlMAS-LA PLATA PROJECT <br /> <br />WHEREAS, the Constitution and By-Laws of the Ute Mountain Tribe, approved June 6, 1940, <br />and subsequently amended, provides in Article m that the governing body oithe Ute Mountain <br />Ute Tnlle is the Ute Mountain Ute Tribal Council and sets forth in Article V the powers oithe <br />Ute Mountain Ute Tnllal Council exercised in this Resolution; <br /> <br />( <br />\ <br /> <br />WHEREAS. the Colorado Ute Water Rights Settlement Act of 1988 (pL. 100-585), <br />subsequently amended in 2000 (P .L. 106-554, Title IIl), authorizes the Ute Mountain Ute Tribe <br />and the &outhern Ute Indian Tribe to participate in the construction of the Animas-La Plata <br />Project ("Project") pursuant to the relevant provisions of Public Law 93-638; <br /> <br />wimREAs, the Ute Mountain Ute Tribe and the Southem Ute Indian Tolle have agreed to <br />divide certain work aisociated with the construction of the Project, specifically Task m of the <br />master list of ALP tasks concerning Ridges Basin Dam (D. Dam and Outlet Works); <br /> <br />WI:1EREAs. the tribes agreed to jointly plU'Sue work associated with Borrow Area processing <br />necessmy for construction of the Project; <br /> <br />WHEREAS, the tribes have agreed to divide the work associated with Borrow processing and to <br />describe in this Resolution their respect roles; <br /> <br />WHEREAS, Sky Ute Sand and Gravel, a wholly owned enterprise of the Southern Ute Indian' <br />Tribe, has agreed to process and supply batched materials for the ProjCct including concrete, <br />flowable 00, road base and asphalt through a contract with Weeminuche Construction Authority, <br />a wholly owned enterprise of the Ute Mountain Ute Tolle; <br /> <br />WHEREAS, the Tribal Council welcomes the participation of the Southern Ute Indian Tribe in <br />the coostruction of the Project and believes it isbene:ficial to both tribes to provide the processed <br />materials as described above; <br /> <br />WHEREAS, the Ute Mountain Ute Tribal Council believes the use of Sky Ute Sand and Gravel <br />as set forth in this Resolution is in the Tribe's best interests; <br /> <br />Page 1 of2; <br />Resolution Number <br />
