<br />002044 <br /> <br />DATE: November 1, 2002 <br /> <br />RESOLUTION NO. 2002-164 <br /> <br />RESOLUTION <br />UTE MOUNTAIN TRIBAL COUNCIL <br />REFERENCE: APPROVAL OF THE ANIMAS - LA PLATA <br />MASTER CONSTRUCTION CONTRACT <br /> <br />WHEREAS, the Constitution and By-Laws of the Ute Mountain TnDe, approved June 6, 1940, <br />and subsequently amended, provides in Article m that the governing body of the Ute Mountain <br />Ute Tribe is the Ute Mountain Ute TnDal Council and sets forth in Article V the powers of tho <br />Ute Mountain Ute Tn'bal Council exercised in this Resolution; <br /> <br />WHEREAS, the Colorado Ute Water Settlement Act, as amended. authorizes the construction of <br />the Ridges Basin Dam as part of the .An;m~~ - La Plata Project and provides to the UteMcnmtain <br />Ute and the Southern Ute Indian Tn'bes the opportunity to participate in the Project through the <br />provisions of Public Law 93-638; <br /> <br />, <br />, <br />\ <br /> <br />WHEREAS, the Ute Mountain Ute Tribe ("rribe''), through the Weeminuche Construction <br />Authority, and with the consent of the Southem Ute Indian Tn'be, has taken on the responsibility <br />IlDder the provisions of Public Law 93-638 to construct the Ridges Basin Dam and certain related <br />projects; <br /> <br />. . <br />WHEREAS, in order to best achieve the many contractual negotiations required to cons1mct the <br />Ridges Basin Dam and each related project in the most efficient and cost effective m~nner; the <br />Tribe and the Bureau of Reclamation have negotiated a single Master Contract of General <br />Provisions for Se1fDetermination Construction Contracts for Construction of Ridges Basin <br />Dam, Inlet Conduit, Durango Pumping Plant, and Appurtenant facilities of the Animas - La <br />Plata Project Durango, Colorado ("Master Contracf'); <br /> <br />WHEREAS, the Master Contract sets forth provisions, tenns, and conditions that will apply to <br />all futnre construction contracts for the individual project features and will be incorporated into <br />each construction contract; and <br /> <br />WHEREAS, the Tribal Council has reviewed the Master Contract and finds it acceptable. <br /> <br />NOW, THEREFORE BE IT RESOLVED that the Tribal Council hereby approves the "Master <br />Contract"; and <br /> <br />BE IT FlNALL Y RESOLVED that the Vice Chairman of the Tribal Council is authorized to sign <br />this Resolution and the "Master Contract" and is further authorized to take such action as may be <br />necessary to carry out the intent of this Resolution. <br /> <br />_.-u <br />Page 1 of 2; <br />Resolution Number <br />
