Completion ofNNMP is projected to be delayed from Fall 2009 to Summer 2011; a delay
of approximately one and three-quarter (1 %) years.

f. Completion of the Permanent Operating Facility is projected to be delayed from Fall 2009
to Summer 2010; a delay of approximately three-quarters (3/4) of a year.

Bearing in mind the preceding discussions, this update shows that activities are progressing at a rate
which will maintain the overall project float established to manage the project. The following table
summarizes overall project progress:

Established Project "Construction Complete" Date
Goal: Maintain six (6) months project float
Benchmark Project "ALP Construction Complete" Date

January 20, 2012

July 20, 2011

Current Schedule "All ALP Construction Complete" Date (see sheet 11 of 11)
Previous Update (July 2005) "All ALP Construction Complete" Date

July 20, 20 II
July 20. 2010

The term "Benchmark Project Construction Complete Date" reflects the Established Project
Construction Complete Date of January 20,2012, less six (6) months of project float. Please note
that float is, in essence, computed based on the Current Schedule "All ALP Construction
Completion" date for construction activities.

The schedule has been updated to reflect the actual dates for construction contract activities, non-
construction activities, and environmental & archaeological work activities. This update maintains
the Durango Pumping Plant and Ridges Basin Dam as high priority work, as we consider these
features to be the project's highest risk work,

Any activity on the schedule related to fish monitoring, environmental monitoring, or non-contract
costs will show negative float. This is because these activities extend beyond the completion of
feature construction activities, Particularly, environmental monitoring items such as the "Animas
River Monitoring in FYI1-FYI4" (Activity FW530) generates the Project Schedule Finish Date of
September 29,2014,

II. Logic Changes.

A. Minor logic changes and updates made under the RBIC Stage #2 Conceptual Design activities.
The updated and projected completion date is Winter 2008, which is approximately four (4)
months earlier than the previous schedule update.

B. The duration for the dam embankment construction work from original ground to dam crest
(Activity RB 1240) was increased to reflect production using a single shift construction
operation in order to reduce the funding level required to sustain double shifts,

III. Other Changes,

A. Navajo Nation Municipal Pipeline has constrained start dates for the award of several contracts
as follows in order to correlate the anticipated funding levels:

a. Award of Direction Drilling Contract

Constrained to

December 2008

2
