Section 148-21-27 (1) (a), Colorado Re'lised Statutes 1963, <br />as amended, requires a tabulation of water rights in order of seniority <br />of all water rights in the water division. <br /> <br />2. This subsection also requires separate priority lists for <br />all water rights which take water from a common source and are in a <br />position to affect one another. <br /> <br />NO <br /> <br />1. A division-wide tabulation of priorities is misleading since <br />water administration would not be handled according to this priority <br />list. <br /> <br />2. /my tabulation of water rights in order of seniority, as <br />presently constituted, are misleading in that the priority number dop.s <br />not coincide with the priority number which is shown on the court decree. <br /> <br />STATE ENGINEER'S POSITION <br /> <br />In order to comply with the statutory requirements, a tabulation of water <br />rights in the entire division is necessary as well as separate priority lists for <br />all water rights in a common source and in a position to affect one another. <br />Decreed water rights have been recorded in the Water Data Bank with adequate <br />programming to obtain a list of water rights according to priority by districts, <br />geographical locations such as townships, tributary streams or any combination. <br />When the final determination is made on operating criteria for the San Luis Valley <br />as a result of hearings on this and other issues, separate priority lists to <br />administer water rights which affect each other will be available. Ample <br />opportuni ty for protesting the final tabulation, including abandonments, is <br />provided in Section 148-21-28, CRS 1963, as amended, This section provides <br />for written protests to the Water Clerk and with the Division Engineer not later <br />than November 30, 1974. <br />
