<br />,'000484 <br /> <br />-11- <br /> <br />b. Colorado agrees to seek $6 million to construct the Towoac <br />domestic water pipeline and distribution system. <br />c. Parties agree to ask the Congress to waive immunity from Tribal <br />lawsuits for damages if the United States fails to deliver water in a timely <br />fashion to the Tribes from the Dolores and Animas-LaPlata Projects. <br /> <br />4. Ratification and Modification of Agreement <br />a. All ratifications required by April 30, 1986. <br />b. No modification to agreement except by joint consent of parties. <br /> <br />5. Repayment Contracts <br />The Tribes and the United States shall execute repayment contracts <br />for the Dolores and Animas-LaPlata Projects which shall: <br />1. be consistent with this Agreement in Principle. <br />11. assure completion of Towoac Canals and laterals by <br />1993, and provide Tribal benefits at least simultaneously with benefits.to <br />nOI).-Indians. <br />111. Assure Tribes preferential rights to design and construct <br />Tribal portions of the two projects. <br />iv. Assure that Tribes are not restricted by Federal laws from <br />leasing waters designated in this agreement. <br /> <br />VIII General'Provisions <br />1. Nothing in the agreement shall be deemed to preclude the Tribes from <br />seeking additional water rights; to limit the rights of parties to litigate issues <br />not covered herein; to authorize the taking of a vested water right; or to alter <br />the effect of any subordination agreement pertaining to priorities of water <br />rights. <br />2. The parties reserve all rights not covered by the agreement. <br />3. Recognition is given to the fact that a dispute remains between the Tribes <br />and Colorado on interstate marketing of water or water rights. <br /> <br />$;- <br />
