An initial total Federal obligation of $622.7 million, composed of <br />$562.2 m1l1ion estimated cost of the Animas-LaP1ata Project and the $60.5 m1l1ion <br />Tribal development fund necessary for settlement of the Triabes' Winters rights <br />claims, is reduced to $451.6 million, or 38% of the combined cost of the <br />project and settlement of the Winters rights claims of the two Tribes. <br />e. See Table 4 for specifics of the financing/cost-sharing proposal. <br /> <br />VII. Finality of Agreement <br />1. Required Congressional Enactments <br /> <br />a. Defer Tribal repayment obligations. <br />b. Waive certain Tribal Winters rights claims. <br />c. waive provisions of the Nonintercourse Act. <br />d. Permit Tribal monetary recovery from the United States if water <br />is not delivered to the Tribes in a timely fashion. <br />e. Ensure completion of Federal obligations in a timely fashion. <br />f. Permit Mancos 'Valley Irrigation District to defer Federal repayments <br />while contributing to cost sharing. <br />G. Provide Federal money for Tribal Development Funds. <br />2. Tudicia1 Approval <br />a. A consent decree incorporating this agreement will be presented <br />to Colorado District Court for Water Division No.7 by October 1, 1986. <br />b. If the court deviates from this agreement in any material way, <br />the agreement may be voided by either the Tribes or the Colorado Attorney <br />General. <br /> <br />3. Remedies In The Event Contingencies Are Not Met <br />a. Partiesc:agree to ask the Congress to appropriate $49.5 million <br />for the Tribal Development Funds, and if Congress faUs to do so the Tribes <br />may void this agreement upon 30 days notice to the Colorado Attorney General. <br />
