Existing Uses - any Existing use of surface or ground water for <br />which the Tribes desire a Winters right shall be identified as to all specifics <br />by Tuly 1, ,1986, and if agreement is reached on them they shall be recognized <br />as additions to the Winters doctrine water rights awarded to the Tribes. <br />b. Future Domestic and Livestock Ground Water Uses - Winters Rights <br />i. Ute Mountain Ute Reservation - 350 acre-ft per year <br />in Me Elmo Creek drainage. <br />ii. Southern Ute Reservation - 2,000 acre-ft per year in <br />LaPlata River drainage with certain limitations. <br /> <br />V. AdministratIon of Tribal Winters Reserve Right Waters <br />'1. State and Tribes acknowledge hydrologic relationships as related to <br />Indians, non-Indians, and interstate compacts. <br />2. The State Engineer willl'a ve administrative responsibility over all waters <br />apportioned to the Tribes at main diversion points from the river. Tribes will <br />. . <br />administer the water on their reservations. Tribes agree to install measuring <br />devices and allow inspections by State Engineer, to furnish information about <br />lands irrigated, and to allow State Engineer to monitor their diversions in case <br />a compact call is put on the river. <br />3. Dams and Reservoirs will be inspected and properly maintained to insure <br />public health and safety. <br />4. Individual and Domestic Livestock Wells - Information will be provided <br />to the State Engineer by the Tribes. <br />5, Aquifer Protection will be provided by the Tribes when they drill, maintain, <br />or abandon wells, and the customary reports will be filed with the State Engineer. <br />6. Change of Use - The Tribes may be granted a change of use of water if <br />the change does not increase the Tribe's consumptive use or injure other water <br />users under described rules en d regulations in the agreement. <br /> <br />ii .,_. <br />
