The Tribes are prepared to prosecute these claims and <br />others against the United States. <br /> <br />III. Definitions <br />The definitions in the main document are self-explanatory and will <br />-not be included ~n this summary. <br /> <br />IV. Quantificat ion of Tribal Claims <br />1. Ute Mountain Ute Indian Tribe shall be entitled to use water from <br />the following sources: <br />a. Dolores Project - average annual supply of 22,900 acre-ft of <br />agricultural irrigation water, 1,000 acre-ft of municipal and industrial (M&I) <br />water, and 800 acre -ft for fish and wildlife development from McPhee <br />Reservoir. M&I wat er will be in full supply. Irrig:ation and other uses <br />except stream fishery releases, will share shortages wi th other Colorado <br />water users, and stream fishery releases will be governed by operating agree- <br />ments between the Bureau of Reclamation and the Dolores Water Conservancy <br />, . <br />District. Construction costs allocable to the Tribe's irrigation water will be <br />deferred under the Leavitt Act. Costs attributable to M&I water will be deferred, <br />with no interest accrual during the deferral period, pursuant to special legislation <br />until revenues can be generated from the M&I wat er. Construction and opera- <br />tion and maintenance (O&M) costs for water used for fish and wildlife develop- <br />ment will be nonreimbursable under section 8 of the Colorado River Storage <br />Project (CRSP) Act. <br />b. Animas-LaPlata Project - 26,400 acre-ft of agricultural irrigation <br />water in Ridges Basin Reservoir and 6,000 acre-ft of M&I water. After completion <br />of the Tribe's irrigation facilities, the irrigation water will be delivered either <br />at Ridges Basin Reservoir or at the Tribe's facilities, as desired by the Tribe. <br />M&I water allocations will be fully satisfied. Agricultural irrigation water <br />will share shortages ,with other Colorado users. Construction costs attributable <br /> <br />~- -;~, <br />
