Accordingly, the States of the <br />Opper Division (Colorado, New Mexico, Uta.h, :md \Vyorriing) and <br />the States of the Lower Division (Arizona, California, and Nevada) <br />shall be relie,'ed from all obligations which may have been imposed <br />upon them by article III(c) of the Colorado River Compact so long <br />as the Secretary shall detennine and proclllim that. means are avail. <br />able and in operation which augment the water supply of the Colorado <br />River system in such quantity as to satisfy the requirements of the <br />Me:xiClln Water Treaty together with any losses of water associated <br />with the performance of that treaty: Pro1~ided, Tha.t the satisfaction <br />of the requirements of the Mexican Water Treaty (Treaty Series 994, <br />59 Stat. 1219), shall be from the waters of the Colorndo River pursu- <br />ant to the treaties, Jaws, and compacts presently reJ.ating thereto, until <br />such time as a feasibility plan showing the most economical means of <br />l\ugmenting the waler supply RV'ailable in the ColorlHlo River below <br />Lee Ferry by two and one-half million acre-feet shall be authorized by <br />the Congress and is in operation as provided in this Act. <br />SEC. 203. (a.) In the event that the Secretary shall, pursuant to sec- <br />tion 201, plan works to import water into the Colorado Rh"er system <br />from sources outside the nntural drainag-e areas of the system. he shall <br />make provision for tldequate and equitable protection of the interests <br />of the States and areas of origin, including assistance from funds speci- <br />fied in this Act, to the end that water supplie.'3 may he. available for use <br />-in such States and areas of origin adequate to satisfy t.heir ultimnte re- <br />quirements at. pri<.'e5 to users not adversely affected.by the eXllOrtation <br />of water to the Colorado River system. - <br />(b) All requiremp.nts, present or future, for wate.r within any State <br />lyin~ wholly or in part within the drainagt>. area oJ anv river basin <br />from which water is eXforted by' works planned pursnant to this Act. <br />shall h:l.Ye a priority 0 right in perpetuity tOltne U~e: of the \,"aters <br />of th-at. riVf'T h:\sin, for all purposes, as again<;t lhe lli1~'~ of th(l. water <br />delivered by means of sllch exportation works, unless oth13rwist>, pro- <br />vided hy interstate agrel"ment. <br />SF..c. 204.
