DOd ~IS <br /> <br />~egulations of fishing on water courses forming part of the frontier which con- <br />tained the following provision: <br /> <br />"Water may not be diverted from the water- <br />courses referred to in Article I, nor may any <br />construotions be erected therein or any steps be <br />taken suoh as to cause damage, by altering the <br />present depth or condition of the parts of the <br />wateroourse situated in the territory of the <br />other Contraoting State, to the extent of water <br />in its territory, or to its fish, land or other <br />property, or thereby to damage the fairway or to <br />enoroaoh upon ohannels used for navigation or <br />timber-floating, unless a special agreement has <br />been concluded in each case between the Contraot- <br />ing States." 19 League of Nations, Treaty Series, <br />pp. 193-195. <br /> <br />Article 2 of the convention relating to the development of hydraulic power <br />affecting mCre than one state, signed at Geneva on Deoember 9, 1923, provides: <br /> <br />"Should reasonable development of hydraulio <br />power involve internati~nal investigation, the <br />Contraoting States conoerned shall agree to suoh <br />investigation, whioh shall be oarried out oon-' <br />jointly at the request of anyone of them, with <br />a view to arriving at the solution most favourable <br />to their interests as a whole, and to drawing up. <br />if possible, a soheme of development, with due <br />regard for any works already existing, under con- <br />struction, or projected". <br /> <br />Artiole 4 of the same convention further provides, <br /> <br />"If a Contraoting State desires to carry out <br />operations for the development of hydraulic power <br />whioh might oause serious prejudice to any other <br />Contracting State, the States concerned shall enter <br />into negotiations with a view to the conclusion of <br />agreements which will allow such operations to be <br />exeouted." 36 League of Nations, Treaty Series, <br />pp. 77, 81. <br /> <br />By article X of the Agreement relating to the construotion of a Storage <br />Dam at Krishnarajasagara on the Cauvery River, signed by Madras and Mysore, <br />states in India, on February 18, 1924, the Madras Government consented to the <br />construction of the Dam, of a oertain oubio oontent, ~ith the proviso that an <br />agreed amount of water should be discharged at oertain times. Both States <br />reserved liberty to extend their irrigation areas within fixed limits, provided <br />that "Mysore shall only construot reservoirs for that purpose of 'an agreed size, <br />and that the waters impounded therein not make any material diminution in <br />supplies."
