Section 7 (a) (1) provides the basis for the <br />recent multi-agency Memorandum of <br />Understanding Regarding Implementation of the <br />Endangered Species Act which requires, among <br />other things, federal agencies to use their <br />authorities to promote the conservation of <br />both listed and non-listed species and their <br />ecosystems. <br /> <br />2. Section 7 (a) (2) requires every federal agency to <br />consult with the Service to ensure that any action <br />it authorizes, funds, or carries out will not <br />"jeopardize" the continued existence of a listed <br />species or "adversely modify or destroy" <br />designated critical habitat. 16 U.S.C. B <br />1536(a) (2); 50 C.F.R. B 402.01 (a). <br /> <br />a. The term "federal action" is broadly defined <br />to include all activities or programs <br />authorized, funded, or carried out, in whole <br />or in part, by federal agencies. 50 C.F.R. <br />B 402.02. <br /> <br />b. Examples include: <br /> <br />~ promulgation of regulations <br /> <br />~ granting of licenses, contracts, <br />permits, leases, easements rights-of- <br />way, or grants-in-aid, and <br /> <br />~ actions directly/indirectly causing <br />modifications of land, water, air, or <br />other elements of a listed species' <br />environment. <br /> <br />3.
