<br />2. Bill title: The Colorado Ute Indian Water Rights Settlement
<br />Act of 1987,
<br />3. Bill status: As ordered reported by the Senate Committee on
<br />, Energy and Natural Resources August3,1988.
<br />4, Bill purpose: S, 1415 would implement the water rights settle-
<br />ment agreement entered into on December 10, 1986 by the Colora-
<br />do Ute Tribes, the Federal government, the State of Colorado, and
<br />several water conservation districts, The settlement contains a
<br />cost-sharing agreement for construction of the Animas-La Plata
<br />project and' plans for allocating water from the Animas-La Plata
<br />and Dolores projects.
<br />Section 4 of S, 1415 would authorize the Secretary of the Interior
<br />to use water from the Animas-La Plata and Dolores projects to
<br />, supply water to the Ute Mountain Ute and Southern Ute Indian
<br />Tribes (Tribes) in accordance with the agreement, This section and
<br />section 5 contain language limiting the application of federal recla-
<br />mation law and clarifying that water supplied to the tribes is sub-
<br />ject to state water law,
<br />Section 6 would specify terms for the deferral and/or repayment
<br />of the construction, operation, maintenance, and replacement costs
<br />allocated to the tribes as a result of the agreement, Section 6 would
<br />also authorize the appropriation of funds to cover the annual oper-
<br />ation, maintenance, and replacement costs as specified in the bill.
<br />This section would also specify repayment procedures for irrigation
<br />water provided to the tribes, including a requirement that repay"
<br />ment above the ability of the tribes to repay be repaid from power
<br />receipts in the Upper Colorado River Basin Fund,
<br />Section 7 would establish two tribal development funds and
<br />, would authorize the appropriation of a' total of $49,5 million over
<br />three fiscal years to be deposited into the funds. Within 60 days of
<br />appropriation of the funds, the Secretary would be required to dis-
<br />burse the funds to the tribes in accordance with formulas specified
<br />in the bilL If funds are appropriated but not disbursed within the
<br />time specified in the bill, the tribes would also be entitled to inter-
<br />est on the unpaid amounts, This section also contains provisions for
<br />the investment and use of the tribal development funds, ,
<br />Other sections of the bill would give the tribes the authority to
<br />waive or release certain water rights claims and would stipulate
<br />that the obligations of the' Secretary as specified in this bill would
<br />only be in force when the tribes execute those waivers, They would
<br />also clarify Congressional intent with regard to the marketing of
<br />water secured by the agreement and would specify the effective
<br />date of the bill,
