With reference to 36 CFR 292.16(c)(2) and (g)(3) and (g) (11) <br />and in order to assure continued protection of the stream banks, beds, <br />and structures of Alturas Lake Creek and the Salmon River, it is agreed <br />that Grantee shall have the right to control grazing of livestock on <br />that portion of the easement area lying within the flood plains of <br />Alturas Lake Creek and the Salmon River as described in Exhibit A <br />attached hereto and incorporated hereto and incorporated herein. The <br />Grantee shall allow maximum grazing which will not cause damage to the <br />present level of vegetative cover within the Salmon River and Alturas <br />Lake Creek flood plains, thus aussuring the continued protection of the <br />stream beds, stream banks and stream structures. In controlling such <br />grazing, Grantee shall have the right to erect fences within such con- <br />trolled grazing area; and if such fences are erected, Grantee shall <br />install a minimum of one style or one gate for each one-quarter (1/4) <br />mile of fence and shall be responsible for maintaining, removing and <br />replacing such fences, gates and styles and for paying all expenses and <br />costs incident to and in connection therewith. <br /> <br />Agreements Governing Public Access: <br /> <br />1. By acceptance of this Easement, Grantee specifically agrees <br />that Grantor, its successors and assigns, shall have the present and <br />future means and rights of ingress and egress to and from the easement <br />area and further agrees that Grantor, its successors and assigns, or <br />invitees, shall not be required to pay an entrance, use, access or other <br />fee when proceeding to and from any part of the easement area. <br /> <br />2. This Easement 1n no way grants to or permits the public the <br />right to enter or use any portion of the easement area for any purpose, <br />other than that portion of the easement area located in the 1:M/4 of <br />Section 28 in Township 8 north, Range 14 East of the B.M., from the <br />thread of the stream to points parallel and being fifty (50) feet in <br />distance, where possible, on each side of the mean high waterline of the <br />Salmon River. On such portion of the easement area Grantee is hereby <br />granted the right to permit the public ingress and egress to the Salmon <br />River and use of the river bank for lawful fishing and traversing the <br />Salmon River. <br /> <br />3.
