<br />owners of such parcels of land shall have the right from time to time to
<br />maintain, improve, repair and replace such buildings, dwellings, improve-
<br />ments, structures, roadways, facilities and fences in carrying out and
<br />furthering the uses and development permitted on the easement area.
<br />
<br />b. In addition to the permitted subdivision and disposition of
<br />the easement area specified in subparagraph "a" hereof, ,Grantor, its
<br />successors and assigns, may subdivide and may dispose of the NE/4 of
<br />Section 5, Township 7'North, Range 14 East, B.M. of the easement area by
<br />sale, gift, devise, transfer or otherwise (except that leases only for
<br />agricultural purposes 8S defined in 36 CFR ~292.l6(g)(1) and mortgages
<br />or similar liens or encumbrances placed upon such portion of the ease-
<br />ment area shall not be considered a disposition thereof); provided that
<br />such portion of the easement area shall not be so subdivided or disposed
<br />of in more than four (4) parcels, of which anyone parcel shall not be
<br />less than forty (40) acres in size, notwithstanding the fact that the
<br />timbered area lying north and east of Alturas L1:ke Creek in the SW
<br />corner of said NE/4 of Section 5 is classified as residential on the
<br />Land Use Category Map. Owners of such parcels of land located in such
<br />portion of the easement area shall not be permitted to construct: (1)
<br />dwellings for their families and employees, (2) buildings, improvements
<br />and structures necessary for agricultural and/or dude ranch operations
<br />and (3) a roadway to such dwellings and buildings from a public road and
<br />such additional roadways, facilities and fences as may be necessary for
<br />carrying out and furthering the u<ss and development permitted on the
<br />easement area; provided, however, that such dwellings and buildings
<br />shall be located only in the W/2NE/4 of said Section 5. Such buildings
<br />and dwellings shall, where possible, be situated in a manner harmonious
<br />with the landscape and general surroundings and shall be of ranch-type
<br />character with log or other rustic exterior with harmoniously colored or
<br />natural wood finish and non-reflective surfaces. The owners of such
<br />parcels of land located in such portion of the easement area shall have
<br />the right to construct and maintain roadways upon such parcels. The
<br />,owners of such parcels of land located in such portion of the easement
<br />area shall have the right from time to time and in harmony with the
<br />western ranching atmosphere to maintain, improve, repair and replace
<br />such buildings, dwellings, improvements, structures, roadways, facil-
<br />ities and fences in carrying out and furthering the permitted uses and
<br />deve.lopment.

<br />5. With reference to 36 CFR ~292.l6(c)(5), it is agreed that
<br />stream beds and banks of live or intermittent streams existing in the
<br />eaaement area will not be disturbed except as may be necessary to COn-
<br />atruct, operate, maintain, repair and replace irrigation or similar
<br />dams, fisheries, ut1lit1es, roads, structures and facilities relating to
<br />or 1n connection with the permitted uses and development. Grantor, its
<br />successors and ass1gns, w1ll construct, operate, maintain, repair and
