<br />( <br /> <br />0012H <br /> <br />3 <br /> <br />c <br /> <br />additional dwellings, buildings, improvements, and structures shall be <br />of ranch-type character with log or other ru~tic exterior with harmon- <br />iously colored or natural wood finish and non-reflective surfaces. <br />Minimum setback of new buildings shall be one hundred fifty feet (150 <br />feet) from public roads where determined feasible by the Area Ranger. <br />Grantor, its successors and assigns, shall also have the right to con- <br />struct new and additional roadways, facilities and fences in carrying <br />out and furthering the permitted uses and development. Grantor, its <br />successors and assigns, shall have the riJht to maintain, improve, <br />repair and replace such new and additionai buildings, dwellings, improve- <br />ments, structures, roadways, facilities and fences in carrying out and <br />furthering the uses and development on the easement area. All con- <br />struction and improvements carried out in fur,the,ance of the permitted <br />uses and development shall be in harmony with the western ranching <br />atmosphere. Nothing in this Easement shall prevent the installation and <br />maintenance of telephone, electric, other utility lines, pipes, conduits <br />and other systems and facilities needed to conduct permitted uses and <br />development in or on the easement area. It is understood that this <br />Section 3 does not alter any of the provisions of 36 CFR ~292.l6(c)(4). <br /> <br />4. With reference to 36 CFR ~292.l6(g)(5) and in addition to the <br />rights, duties and exceptions provided in subparagraph "b" hereof, it is <br />agreed that: <br /> <br />( <br /> <br />( <br /> <br />( <br /> <br />l <br /> <br />a. Grantor, its successors and assigns, may subdivide and may <br />dispose of the easement area in not more than three (3) parcels, by <br />sale, gift, devise, transfer or otherwise (except that leases only for <br />agricultural purposes as defined in 36 CFR ~292.l6(g)(1) and mortgages <br />or similar liens or encumbrances placed upon the easement area shall not <br />be considered a disposition thereof), provided that no part or parcel of <br />the easement area less than eighty (80) acres in size shall be subdi- <br />vided and disposed of. Notwithstanding anything herein to the contrary, <br />one "building site" of ten (10) acres in size shall be permitted on each <br />parcel of the easement area which is so subdivided and disposed of, and <br />the person or entity acquiring and owning such parcel shall be permitted <br />to. construct: (1) dwellings for owners and operators of such parcel of <br />land and for their families and employees, (2) buildings, improvements <br />and structures necessary for agricultural and/or dude ranch operations <br />and (3) a roadway to the "building site" from a public road and such <br />additional roadways, facilities and fences as, may be necessary for <br />carrying out and furthering the permitted uses and development. Such <br />buildings and dwellings shall, where possible, be situated in a manner <br />harmonious with the landscape and general surroundings and shall be of <br />ranch-type character with log or other rustic exterior with harmoniously <br />colored or natural wood finish and non-reflective surfaces. The owners <br />of such parcels shall have the right to specify the location and design <br />of improvements, roadways, fences and facilities upon such parcels, so <br />long as they are in harmony with the western ranching atmosphere.
