<br />lJJ2374 <br /> <br />o Implementation of these Procedures will contribute to fulfilling <br />the intent for the Recovery Program to serve as the "reasonable <br />and prudent alternative" for certain types of water development <br />in the Upper Bas i n1 . <br /> <br />o The Recovery Program directs that "stocking of nonnative species <br />will be confined to areas where the absence of potential conflict <br />with rare or endangered species can be demonstrated. This <br />includes augmentation of existing populations of nonsalmonid <br />fishes and introductions of new populations of all nonnative fish <br />species that compete with or prey upon rare species." The <br />Procedures clarify that the Recovery Program is not intended to <br />abolish stocking of nonnative fishes in the Upper Basin but was <br />designed to guide stocking so that it is consistent with recovery <br />of the endangered Colorado River fishes. <br /> <br />o The Recovery Program will operate consistent with State and <br />Federal law. <br /> <br />2. It is intended that the Recovery Program will accept the Procedures. <br /> <br />3. It is intended that these Procedures will be implemented by a <br />Memorandum of Understanding among the State wildlife agencies and <br />the Servi ce. . <br /> <br />4. The Service and the States each have statutory responsibilities <br />which can not be abrogated. The States have the responsibility for <br />managing the States fi shandwildl ife resources, whi ch i ncl udes <br />threatened and' endangered species occurring within its boundaries <br />and decisions related to fish stocking. The Service has certain <br />legislated responsibilities for conserving fish and wildlife <br />resources including administering the Endangered Species Act. <br /> <br />5. The goal of the Service and the States is to reach consensus on <br />issues related to stocking of nonnative fishes so that neither <br />agency has to independently assert its authority. The Service and <br />the States will make a concerted effort to resolve any disagreements <br />that may'ari se over a stocki ng proposal. <br /> <br />6.
