<br />. <br /> <br />. <br /> <br />. <br /> <br />001824 <br /> <br />was made to secure a water right decree for this storage, nor for the <br /> <br />winter flol'/ through the lake, which the town has used ever since the <br /> <br />cri~ was built. <br /> <br />As of August 26, 1926, the Fire Mountain Canal and Reservoir <br /> <br />Co., owner of a large canal taking water from North Fort: of Gunnison <br /> <br />River just below SOmerset, filed an enlargE!llent on Lake Brennan intended <br /> <br />to raise the w~ter 3D feet above the high water line of Crested Butte <br /> <br />storage and to store 1,200 acre-feet in addition to Crested Butte stor- <br /> <br />ago. No work has been done under this filing. <br /> <br />During the summer of 1934, I/hen all etrellllle were very low, cer- <br /> <br />toin persons said to ropresont the Fire Mountain C. & R. Co., attempted <br /> <br />to blowout tho timber crib belonging to the town of Crested Butte and <br /> <br />thus release for use on North FOrk, the water stored by the town. It <br /> <br />is reported that thefle people had already passed through the leke the <br /> <br />contents of several Leaver ponds located above the leke which had been <br /> <br />dynamited and drained. The town secured an order of court preventing <br /> <br />further interference with the reservoir and a long period ot negotiation <br /> <br />followed. <br /> <br />turing this same perioil, ill a general adjudication in Water <br /> <br />District No. 40, Ivhich includes Anthracite Creek, the Fire MountBin <br /> <br />Canal & Reservoir Co. obtained two conditional decrees: <br /> <br />H4 - Leke Brennan, (Lake Irwin) lie of 9/1/24, for 925.24 Ac.Ft. <br />stipulllted to be an enlargement of Lake Brennan above 367.3 <br />acre-feet admitted to be the right of the town of Crested <br />Butte. The Court ordered that the tOVlIl could not increase <br />its storage without building a high dam which it must do not <br />later than l2/31/Y7. <br /> <br />H60- Lake Bronnan (Lake Irwin) as of 8/21:,/26, for 832.7 ncre- <br />feet. This decree recites the same stipulations as to <br />the rights and duties of the town of Crested Butte. <br /> <br />-17- <br />
